Rubicon Impact & Litigation is a specialist in class action claims and is committed to helping victims seek justice.
Some issues are too large or complex for individuals to handle on their own, such as fighting major polluters or standing up as a consumer against a multinational. At the same time, some matters are too small (financially) for individuals to start legal proceedings. There may also be instances in which a third party wants to represent a broader public interest. In these cases, it is not about the individual outcome, but about preventing or compensating damage to the interests of vulnerable or voiceless groups, or to the public interest.
Collective compensation claims provide an effective solution in all these scenarios, allowing multiple victims to join forces in seeking justice. The consolidation of claims strengthens the position of groups of victims, giving them more resources and flexibility to address wrongdoing. Idealistic collective action, often without a financial damages aspect, is another way to address malpractice.
The lawyers at Rubicon Impact & Litigation are specialised in handling complex and innovative class action cases and have successfully led a number of high-profile collective proceedings.
- Rubicon Impact & Litigation represents the Stichting Massaschade & Consument in the collective action against Google for the unauthorised collection of massive amounts of user data from smartphones. This lawsuit aims to obtain compensation for users who lost control over their personal information. The goal is to hold Google accountable for disregarding privacy rights and ensure that consumers regain ownership and protection of their data, in line with EU privacy legislation.
- The lawyers at Rubicon Impact & Litigation represented Fossielvrij NL and Reclame Fossielvrij, alongside ClientEarth, in the world’s first civil lawsuit against greenwashing by an airline – namely KLM. In March 2024, a Dutch court ruled that KLM’s greenwashing in its advertising was unlawful, setting an important legal precedent with ramifications for the entire international aviation sector and for all companies advertising their involvement in the Paris Climate Agreement. For more information on this case, see this summary on Rechtspraak.nl.
- The lawyers at Rubicon Impact & Litigation lawyers worked together with Grant & Eisenhofer and KTMC, in representing South Africa’s civil servants’ pension fund and its largest asset manager, The Public Investment Corporation, plus some 45 other institutional investors in the accounting fraud case at the South African company Steinhoff. With the help of our team, the dispute resulted in a global settlement of €1.6 billion, one of the largest securities settlements outside the United States to date.
- We are representing the Equal Justice Equal Pay Foundation (EJEP) in a collective action against Dutch shipowners over long-standing wage discrimination in the maritime industry.
